In Morton v. Rabito, a backhoe was held not to fall within the definition of automobile either in ordinary parlance or within some enlarged definition of the term found in the policy and the court followed its decision in Regele in holding that the definition found at s. 224(1) took precedence over that in s. 1 of the Act.
