The plaintiff submits that strict liability should be imposed in respect of abnormally dangerous activities, arguing that most citizens would not expect that a police dog would attack without command in the presence of his handler and while on leash. Although counsel for the plaintiff could not point to any authority supporting the imposition of strict liability, it is suggested that this was “alluded to” by Neilson J. in Rosario v. Gladney et al., 2000 BCSC 214.
