Can an agreement by the parties of Fort McMurray (City) and the Agreement of Agreement give the parties the authority to set up an enforcement board?

Alberta, Canada

The following excerpt is from U.N.A. (Local 33) v. Royal Alexandra Hospital, 1994 CanLII 9247 (AB QB):

C.U.P.E.,Local 1505 v. Fort McMurray (City) (supra) did not consider whether the parties can, by their agreement, give a board the jurisdiction over matters in relation to which legislators have incorporated public policy into a specific enforcement procedure. I do not need to consider this question in view of the decision I have arrived at in the immediately preceding paragraph.
