Where parties have made multiple offers, a cost consequence may flow from the first offer despite it being revoked or lapsed. The court must determine whether an offer that ought to have reasonably been accepted while open, and I cite Sauer v. Scales, 2012 BCSC 1883, for that proposition at paras. 8, 11 and 14.
