There is support for the above conclusions in a previous judgment, Beazley v. Suzuki Motor Corporation, 2010 BCSC 681. In that case the plaintiffs sought to admit 17 “complaint-related documents” about rollover accidents involving a tractor. They were not intended to be entered for their truth but to demonstrate that the defendant had failed to take steps to modify or correct the vehicle. Justice Goepel (as he then was) concluded, among other things, that the documents did not explain the many causes of motor vehicle accidents and he did not admit them (at paras. 40-42). I note in the subject litigation the plaintiffs go further than in Beazley since they seek to have the letters from the 28 individuals at issue here entered for the truth of their contents.
