The Defendant submitted that the case Miron v. Trudel, 1995 CanLII 97 (SCC), [1995] 2 S.C.R. 418 (S.C.C.) stands for the principle that under s. 15(1) of the Canadian Charter of Rights and Freedoms, unmarried persons should enjoy the same protection and benefits of the law as married persons. It should also be true that unmarried persons should not receive greater benefits and protection than married persons.
