The parties agree that the court has the jurisdiction to make the order and that the test as set out in Jiwa v. Jiwa, [1992] B.C.J. No. 3024 at para. 8 (S.C.) is a twofold one that asks: a) Is the advance required to mount a challenge to the other spouse’s position at trial? b) Will an advance or a payment of an interim distribution jeopardize the other spouse’s position at the trial?
