I have read the cases cited by both parties in their submissions and I agree with the respondent that the parties should be given an opportunity to provide an argument in respect to whether the costs award in the Reasons should be varied. In particular, to consider the four step inquiry set out in Fotheringham v. Fotheringham, 2001 BCSC 1321.
