Natalia was not confronted on cross-examination regarding her state at the time of the signing of the Bill of Debt by Viktor. If the defendant intended to rely on that evidence at trial, he was obligated to have put it to Natalia on cross-examination pursuant to Browne v. Dunn, (1893) 6 R 67 (HL). I therefore place very little weight on this evidence.
