Much of the parties’ evidence was diametrically opposed, even on inconsequential facts. Important facts concerning the parties’ conduct should not and will not be resolved on this interim application. In addition, much of the evidence before the court on these applications was inadmissible hearsay: Creber v. Franklin, [1993] B.C.J. No. 890 (S.C.).
