The claimants cited Ho v. Yip, [1995] B.C.J. No. 1253 (S.C.), in which a fiduciary relationship had been found to exist in a construction context. He distinguished that case on the basis that the plaintiffs were particularly vulnerable to the defendants and had much less control over the decisions made by the defendants than did the respondent in the matter before the arbitrator.
