In Appleyard v. Essex Terminal Railway, [1997] O.J. No. 3226 (O.C.J. - Gen. Div.) at para. 18, the court rejected that special circumstances existed to impose a duty of care on an employer with respect to a public sidewalk used by its employees to access a parking lot set aside for employee use.
