In the case of Romagnuolo v. York (Regional Municipality) Police, [2001] O.J. No. 3537, the court confirmed that a claim for a breach of fiduciary duty is not available with respect to police officers carrying out their functions because they owe a duty to the public at large, rather than individual members of the public.
