Similarly, in Adkens v. Hunter, 2003 BCSC 97, the plaintiff was found 25% responsible for the injuries he suffered as a result of a vicious attack by the defendant by reason of the plaintiff’s provocative conduct. In coming to this conclusion, Slade J. held that the loss of self-control necessary to establish provocation may be inferred from the evidence:
