The following excerpt is from Herriman v. Beresford, 2012 BCCA 437 (CanLII):
If a respondent’s jurisdiction does not require a provisional variation order, then only the court in the respondent’s jurisdiction is engaged: Mathers v. Bruce, at paras. 5, 23, 38, 41. An applicant need only complete a support variation application in the jurisdiction in which he ordinarily resides and submit that application to the designated authority in his home jurisdiction.
