The following excerpt is from Rockel v. Kent, 2011 ONSC 3925 (CanLII):

The court in Kolt continued at paragraph 27 "I do not accept the father's premise that the hours the children are in school or are en route to school should be excluded as the children are in neither party’ s care during those hours.” The court went on to approve the reasoning in the 1997 case of Meloche v. Kales.
