The plaintiff submitted that a consent order is contractual in nature and should be distinguished from other orders, such as a divorce order: Thien v. Thien, 2000 BCSC 827 at para. 18. As I understand the argument, the contractual nature of a consent order supports the argument that there was no adjudication on the merits.
