Although the conduct of the solicitor in this case dealing with the plaintiff’s action and arranging for prompt service was less than exemplary that is not the focus of consideration for the court. As Laskin J.A. said in Chiarelli v. Weins (supra) at para. 9: The motions judge correctly stated that, on a motion to extend the time for service, the court should be concerned mainly with the rights of litigants, not with the conduct of counsel.
