The following excerpt is from Moore v Smith Construction, 2013 ONSC 5260 (CanLII):

As stated in Ryan v. Victoria (City), 1999 CanLII 706 (SCC), [1999] S.C.J. No. 7 at paragraph 29, legislative standards are relevant to the common law standard of care but the two are not necessarily co-extensive. I would add industry practice to this proposition as well.
