The Code seeks to protect persons from discrimination in employment due to age. It provides protection from discrimination due to stereotypical views concerning the older employee. Such views respecting older employees may include assumptions that since the employee has been doing a particular job for a long time they would be unable to adapt to a new position, that older people cannot learn new skills, that they will be slow to learn or exhibit slow performance, that they will wish to retire, or that if they are terminated, they have less to lose as they are closer to retirement than a younger person: Buchanan v. WMC Management Services, 2006 BCHRT 339 at para. 84.
