The last case upon which the plaintiffs rely is Mason v. Regional Medical Centre of Hopkins County, 121 F.R.D. 300 (W.D. Ky. 1988), which was a case where a patient, who was treated in a hospital, had a transfusion that was contaminated with the AIDS virus and that patient then tested positive for the presence of the AIDS virus. She then brought action against the hospital alleging negligence, and strict liability for supplying an unreasonably dangerous product, and breach of an implied warranty of fitness. The donor of the unit of blood that was given to the plaintiff had been identified and that donor had been permitted to intervene in the action as "John Doe" in order to move for a protective order to keep his identity confidential.
