Brooks-Martin v. Martin, 2011 BCSC 194, a decision of Halfyard J. was cited for the general principles previously stated. There, the forward motorcycle cut in front of the rear motorcycle as both motorcycles were approaching a stationary truck. It was conceded the stationary truck driver was not liable and the rear motorcyclist was, in fact, at fault for being too close to the forward motorcyclist.
