The following excerpt is from Malkin v. Crown Life Insurance Co., 1989 CanLII 2898 (BC SC):

Under the rule set out in McCulloch v. Calgary, supra, and the American Une of cases, once the insurer initially accepts an insured is totally disabled within the meaning of the policy, the burden is on the insurer to prove the insured can work or he is no longer disabled. In this instance, the defendant fell well short of meeting that burden.

Assuming the law is that declared in the authorities as exemplified by Porter v. Metropolitan Life Ins. Co., supra, the burden of proof is on the plaintiff to prove he cannot work or that he is totally disabled. On the evidence I heard, he met that burden.
