I do not regard this list as intended to be exclusive. Indeed, in Peter v. Medtronic, there was a finding by the motion judge, Perell J., that without bifurcation there would be prejudice to the defendant as a result of the disclosure of confidential and commercially sensitive business and financial information and it is clear that this factor weighed heavily in his decision.
