In assessing whether a cause of action has been adequately pleaded, the basic function of pleadings should be kept in mind. This was summarized by K. Smith J., as he then was, in Homalco Indian Band v. British Columbia (1998), 25 C.P.C. (4th) 107 at para. 5, as “clearly defin[ing] the issues of fact and law to be determined by the court”. He went on to provide a useful guide to the elements of a cause of action that the material facts will ordinarily cover:
