The Attorney General cites Richard v. British Columbia, 2008 BCSC 254, affirmed at 2009 BCCA 185, a case dealing with abuse at a provincial institution in British Columbia. The class period for claims in both tort and breach of fiduciary duty was limited to claims arising after the British Columbia Crown Proceedings Act came into force. It was thus plain and obvious that no cause of action before that date could survive.
