The Arbitrator in this case correctly set out the statutory test (from s. 47 of the RTA), found the necessary facts, and then applied those facts to the test that had to be met. The reasons of the Arbitrator allow the parties and the court to understand the conclusion reached by the Arbitrator. Accordingly, the Arbitrator fulfilled the statutory requirement in s. 77 of the RTA to provide reasons for decision: Hawk v. Nazareth, 2012 BCSC 211 at paras. 11-16.
