Moreover, the appellants are asking us to disregard the recent decision by our Court in Sheriff v. Canada (Attorney General), 2006 FCA 139, where our Court, per Malone J.A., unanimously determined that there is no reasonable apprehension of bias as long as the functions of prosecution and adjudication are not performed by the same person.
