At the outset of this appeal an application was made by the respondents to quash the appeal on the grounds of mootness. We are, however, satisfied on the principles of Borowski v. Attorney General of Canada (1989) 1989 CanLII 123 (SCC), 57 D.L.R. (4th) 231, that it is appropriate and in the interests of all concerned that it should proceed.
