The husband says, in summary, that the Agreement is fair. He points out that it, in fact, provided for a reapportionment in that he agreed to the arrangement whereby the wife and children would live in the family home for three years: Barker v. Barker, [2002] B.C.J. No. 1193 (B.C.C.A.) at para. 54. She would have the ability to tie up a significant portion of his share of the assets.
