It is difficult to resolve the contradictory statements regarding the nature of the parties’ relationship. However, in the unusual circumstances of this case, I need not do so. There is no question that the abuse of a spouse can be a relevant consideration when considering whether the return of a child might place her in an intolerable situation. In Pollastro, the father’s treatment of the mother was a significant factor in the court’s decision to deny the return application. Similarly, in Husid v. Daviau, 2012 ONSC 547, aff’d 2012 ONCA 655, the court concluded that the treatment of the mother by the father and his family in Peru would create a risk of harm to the child if she was returned.
