57. Fines are assessed to discourage violations of a strata’s bylaws – not to correct bylaw violations. As such, the purpose of fines is punitive rather than compensatory (See Kok v. Strata Plan LMS 463 (1999), 23 R.P.R. (3d) (B.C.S.C.).
