45. In Lum v. Strata Plan VR 519 BCSC 49 the court held that a strata council has a duty to have the strata properly represented in legal proceedings concerning it. While some owners may oppose legal proceedings, or oppose obtaining legal advice for the strata, this does not alter the strata’s obligation to arrange for representation.
