The respondent owners rely on Imbeau v. Strata Plan NW971, 2011 BCSC 801. In that case, the chair of a strata corporation had decided, in accordance with the bylaws, to hold a secret ballot. The vote was not conducted by secret ballot and the vote and passing of the resolution were declared by the court to be null and void.
