Sriskandarajah's complaint that he was denied procedural fairness at the surrender stage of the extradition process rests on his contention that the Minister was obliged to disclose the assessment of the Canadian prosecuting authorities concerning the feasibility of prosecution in Canada, conducted in accordance with United States of America v. Cotroni, 1989 CanLII 106 (SCC), [1989] 1 S.C.R. 1469, [1989] S.C.J. No. 56. Nadarajah advanced an identical argument on his judicial review application. This contention is flawed.
