What is the current state of the law on spousal support?

The above sections and the principles enumerated in Bracklow have been considered in many spousal support cases. In Snodgrass v. Snodgrass, 2004 CarswellNB 42, Wooder J. set out a useful framework for an analysis of spousal support: standing (no issue in the case at bar), entitlement, form, duration and amount. However, spousal support still appears to be discretionary, and consequently not predictable. There is some agreement that if support is ordered to allow a spouse to adjust to independence where there is no real economic consequences arising from their roles in the marriage, then support should be time limited (see Bracklow).
