Special costs are a penalty for reprehensible conduct. Such conduct is described in Leung v. Leung (1993), 77 B.C.L.R.(2d) 314 (B.C.S.C.) where Esson C.J.S.C. (as he then was) said that “reprehensible” is a word of wide meaning that can include conduct which is scandalous, outrageous or constitutes misbehaviour; but it also includes milder forms of misconduct. It means simply “deserving of reproof or rebuke.”
