Mr. Justice Cumming’s judgment on the issue of costs was the judgment of the court in Young v. Young. He considered the basis for awarding costs on a solicitor-and-client footing and the circumstances under which costs are awarded against a non-party. With respect to solicitor-and-client costs, the principle adopted by this court is that solicitor-and-client costs should be awarded only in exceptional cases where there has been reprehensible, scandalous or outrageous conduct deserving of chastisement.
