The following excerpt is from Childs v. Desormeaux, 2002 CanLII 17070 (ON SC):

Although in Kelly v. Gwinnell they find social host liability, this case has not been followed by other states. It would appear that some states have found social host liability where the social host has served the alcohol to a person who was intoxicated and the host was aware the guest was going to drive a motor vehicle.
