For example, in Smith v. Smith, 2008 BCCA 245, the husband had transferred his beneficial interest in a rental property to a corporation, of which he held 100% of the shares. Madam Justice Newbury determined that the rental property had been ordinarily used for a family purpose, but in applying the definition in s. 58(3)(a), held the shares to be family assets.
