The following excerpt is from Pittman Estate v. Bain, 1994 CanLII 7489 (ON SC):

In Smith v. Millington, the plaintiff received long-term disability benefits from an insurance company. Although the premium for this disability insurance was paid entirely by the plaintiffs employer, it was listed as part of the employees’ compensation package. The employment contract must be deemed to have been the result of prudent negotiations, and could not be ignored simply because its benefits were available to a large number of individuals.
