The defendant submits that any amount awarded to replace sick leave credits constitutes double compensation. I do not agree. As Madam Justice Ballance noted recently in Bjarnson v. Parks 2009 BCSC 48, at para. 56, this court has long recognized the loss of sick leave trust credits as a compensable loss. However, the issue of whether or not deductions should be made for contingencies in quantifying that loss depends upon the presence or absence of a number of factors.
