In Gibney v. Conohan, 2011 NSSC 268 I observed that the absence of shared parenting can create a perceived and actual power imbalance in one or both parents and result in an abuse of one’s parenting position. It is clear that Ms. Cole is empowered by her conclusion, after calculating parenting time; that she has more than 60% of the parenting time. She believes she is the primary care parent and her views are always paramount. She does not distinguish between the allocation of parenting time and decision making. These are different aspects of custody and need not lay on top of each other.
