One reason severance orders are only exceptionally granted is that they can give rise to embarrassment or to unnecessary obstruction of the trial of the remaining issues. As Punnett J. pointed out in Element v. Del Mar, when the credibility of the same witness or witnesses is at issue in both the severed issue and the remaining issues, then severance is unlikely to be appropriate.
