Romana v. CBC et al., 2020 MBQB 72, was another case in respect of security for costs. The plaintiff was self-represented and made many procedural errors. He got leave to amend his Statement of Claim once, and wanted leave to amend it again. He was on social assistance and had no assets. The defendants argued that his claim had no merits at all. The motion judge expressed his mixed feelings at paragraph 27. Ultimately, he felt that the “tipping point” was the plaintiff’s impecuniosity. An award for security for costs would prevent him from going forward. While denying security for costs, the motion judge (who was also the case management judge) ruled that the plaintiff could not take any further steps without the judge’s permission.
