A section 7 challenge involves a two stage inquiry. First, a claimant must establish deprivation one of the protected interests; life, liberty or security of the person. Second, if the claimant meets the burden of establishing the deprivation, then the claimant must establish that the deprivation was not in accord with the principles of fundamental justice.
