The appeal board noted the jurisprudence on the limited scope and purpose of a section 21 appeal. The appeal board cited a passage from the case of Leckie v. Canada, 1993 CanLII 2956 (FCA), [1993] 2 F.C. 473 (F.C.A.) rejecting the argument that an appeal can be used as a means of establishing or protecting a person's entitlement to a promotion. The appeal board then stated the following conclusion:
