Searches conducted pursuant to a search warrant are presumptively reasonable, all warrantless searches are presumptively or prima facie unreasonable, per Southam v. Hunter, 1984 CanLII 33 (SCC), [1984] 2 SCR 145. The crown has the burden to rebut this presumption of unreasonableness.
