In Schneider v. Steure, [1992] B.C.J. No. 491 (S.C.) [Schneider], the defendant's vehicle struck a moose attempting to cross the highway, causing the vehicle's windshield to shatter. The defendant did not stop at the scene but subsequently informed the RCMP of what occurred. Shortly after the collision, the plaintiff was travelling in the opposite direction and noticed the moose carcass on the roadway. The plaintiff swerved to the right, in an effort to avoid the carcass and drive around it. The plaintiff was unsuccessful in doing so and struck the moose carcass.
