The respondent submits that Salomon v. Salomon 1897 A.C. 22 applies, and it matters not that the purchasers in setting the price to be paid for the shares didn't pay any value for such an action as the present one or that the vendors had no intention of selling the same. The contention is that the right is that of the company and the position of the shareholders should be disregarded.
